Operadora 191 S.A. de C.V. with address at Calle Monterrey number 191, Colonia Roma Norte, Delegación Cuauhtémoc, Ciudad de México, CP 06700; indicating said address for the purposes of this Privacy Notice in compliance with the Federal Law on the Protection of Personal Data in the Possession of Individuals, shall be responsible for the personal data provided by the owner, whether a natural person or a legal entity.

PERSONAL DATA REQUIRED FROM THE HOLDER

For the purposes indicated in this privacy notice, the person in charge may collect personal data from the owner, the individual or company and/or their representatives:

Name, Address, Telephone or cell phone, e-mail, Official Identification, Marital Status, CURP, Position, Account Number, Credit and/or Debit Card and its confidential data, Photograph, Autograph or Digital Signature, Fax, Nationality, Date and place of Birth, RFC, Information on assets, Economic Activity; all of them together making up the "Personal Data" which may be provided directly or indirectly, personally or electronically and through sources permitted by the legal provisions in force.

It is the responsibility of the Owner of the Personal Data to guarantee that the data provided directly or indirectly, personally or via electronic means and through sources permitted by the legal provisions in force are true and complete, notifying any modification to them to comply with the principle of truthfulness and updating.

PURPOSES

The information that is collected by Operadora 191 S.A. de C.V. will be used in order to comply with the relation corresponding to the provision of Hosting, Lodging or any of its similar modalities, for the identification of the holder, for the development of the services, to fill the necessary forms in order to provide a complete and satisfactory service, to contact the holder in his character of beneficiary to give fulfillment to all the offered services and to provide security to the facilities as well as to the users or other holders that enter to the same ones.

Likewise, Operadora 191 S.A. de C.V. will use the Holder's information to offer and promote its services, packages, offers, plans, memberships, innovations, evaluate the quality of the services, purposes that are not necessarily required so in case the Holder does not agree that Operadora 191 S.A. de C.V. use your personal data for such purposes you must express your opposition through your rights of Access, Rectification, Cancellation or Opposition, related to your personal data (ARCO Rights) by contacting our personal data processing manager at the email address administracion@roma191.com.mx, in case you do not express your opposition it will be understood that you give your consent to Operadora 191 S.A. de C.V.

TEMPORARY

The personal data will be handled during the time in which the legal or factual relationship of the service is maintained, as well as the obligations required by the laws in force, the regulations and internal policies of Operadora 191 S.A. de C.V.

In relation to the data obtained by recording or video recording means and its similar, such as the image captured of the holder or his voice will be kept only for a period of 30 (thirty) to 90 (ninety) working days after the date in which it is obtained unless there is an order notified in time and form by a judicial authority.

The information that is given to Operadora 191 S.A. de C.V. may be shared through a referral to those persons that maintain a labor link with the company such as general managers, plant managers and workers, as well as service providers and commercial partners that have a legal or factual relationship with Operadora 191 S.A. de C.V., that derived from such relationship need to know the information and assume the commitment to protect and safeguard it under a strict commitment of confidentiality acknowledging having full knowledge of the terms and conditions of this privacy notice.

Likewise, if the owner does not agree that Operadora 191 S.A. de C.V. uses his personal data for such purposes, he must express his opposition by means of his rights of Access, Rectification, Cancellation or Opposition, related to his personal data (ARCO Rights) by contacting our person in charge of the treatment of personal data at the following email address administracion@roma191.com.mx. If he does not express his opposition, it will be understood that he grants his consent to Operadora 191 S.A. de C.V.

When personal data is required by a competent authority of any kind or must be delivered to the latter, it will be made available as indicated by the Law without requiring the consent of the owner in accordance with current legislation.

MECHANISMS, MEANS AND PROCEDURES AVAILABLE TO EXERCISE RIGHTS OF ACCESS, RECTIFICATION, CANCELLATION OR OPPOSITION, RELATED TO YOUR PERSONAL DATA (ARCO RIGHTS)

The holders of the personal data will have the right to request Access, Rectification, Cancellation or Opposition, related to their personal data (ARCO Rights) by: 

Request formulated to the e-mail administracion@roma191.com.mx designated of the society called Operadora 191 S.A. de C.V. which will give answer as long as some of the exceptions contained in the Law are not updated and the requirements that such requests presented by the Titulars must contain are fulfilled, likewise such request must be accompanied by the information and documentation conformed by Name, Address and means of contact to give answer to the request, document that accredits the identity or the legal representation of the Titular and the clear and precise description of the personal data with respect to which it is sought to exercise the Access, Rectification, Cancellation or Opposition, related to its personal data (ARCO Rights).

Operadora 191 S.A. de C.V. will respond to the request of the holder regarding the Access, Rectification, Cancellation or Opposition, related to his personal data (ARCO Rights) within the terms established by the Law.

MODIFICATIONS TO THE PRIVACY NOTICE

In the event that Operadora 191 S.A. de C.V. requires to use its data with different purposes than the ones agreed or agreed according to the legal or factual relationship with the Holder and in this Privacy Notice, the Holder will be notified in a written or electronic form that allows explaining the new uses that will be given to the Holder's personal data, the holders of the information will be duly informed of the data that was collected from them as well as the purpose of such data, the Privacy Notice will be available at any time in the electronic page.

This Privacy Notice is governed by the legislation in force and applicable in the United Mexican States. Any dispute that may arise shall be referred to the competent jurisdictional bodies.
